This defendant hs no copy of the testimony taken at the hearing when his rights were placed in evidence, but submits that such evidence establishes that defendant, J.E. Ayer, has certain appropriation or riparian rights as so appears by such evidence.

These rights seem to be recognized by plaintiff. (See plaintiff's brief, riparian schedule, page 161.)

This being so, we take it that no extended brief need be filed.
