L. E. BROWNELL, R.H. BROWNELL, I.L. BROWNELL and MRS. L.R. BROWNELL, defendants herein, respectfully protest against the Proposed Findings and Decree herein on the ground that neither in the Findings nor in the Decree are the rights of the defendants as riparian owners along stony Creek correctly defined or adjudicated in accordance with the recent decision of the Supreme Court of the State of California in the case of Herminghaus vs. Southern California Edison Company, 73 Cal. Dec. 1 [what is this cite?], in that said decree limits defendants to the amount of water necessary to irrigate what is described as irrigable land in said Finding and Decree, and, generally, that it does not protect the rights of these defendants to the water of Stony creek.
